UCSB Golf Club Private Membership Association (PMA) Agreement, Terms of Service (TOS), and Liability Waiver
Introduction and Purpose
The UCSB Golf Club is a Private Membership Association (PMA) composed of living men and women who gather in peace to participate in and promote the game of golf under the principles of common law. As such, the Club and its members operate independently of any commercial, corporate, or statutory jurisdiction, upholding values of personal sovereignty, mutual respect, and peace. This document serves as a comprehensive agreement that governs membership in the UCSB Golf Club, outlining rights, responsibilities, and the shared purpose of our association.
1. Membership Terms and Conditions
1.1 Acknowledgment of Private Membership and Common Law Jurisdiction
By signing this agreement, members acknowledge that they are joining a Private Membership Association and that UCSB Golf Club operates outside of corporate, commercial, or statutory jurisdictions. As living men and women, members recognize this association as a private, voluntary union operating in harmony and peace under common law principles.
1.2 Purpose and Vision
The UCSB Golf Club is established with the vision of Project Grow the Game, creating an inclusive and growth-focused golf community. Members voluntarily join to foster personal development, camaraderie, and a shared love for golf, without commercial gain or external influence.
1.3 Membership Levels
Full Membership: Grants access to all activities, including competitive events, practice sessions, and priority entry to tournaments, along with community-driven support, discounts, and resources.
Social Membership: Offers access to social events, the private GroupMe, and a more casual involvement in Club activities, allowing for flexible engagement with the Club’s social side.
2. Code of Conduct
Members agree to uphold the Club’s values, committing to peaceful, respectful, and honest interactions. The Club expects all members to:
Conduct themselves with integrity, honoring the peaceful and inclusive environment we uphold.
Respect the rights and autonomy of fellow members, reflecting the principles of common law.
Abide by the common values of sportsmanship, integrity, and mutual support in all Club activities.
3. Assumption of Risk and Liability Waiver
3.1 Assumption of Risk
All members acknowledge the inherent risks associated with golf and related activities. Participation is voluntary, and members assume full personal responsibility for their safety and well-being, independent of any commercial or statutory protections.
3.2 Release and Waiver of Liability
As a condition of membership, members release UCSB Golf Club, its officers, directors, agents, and other members from any claims, demands, or causes of action that may arise from their participation in Club activities. This waiver applies within the non-commercial, private context of the PMA and under common law principles.
4. Privacy and Confidentiality
The UCSB Golf Club values privacy and confidentiality, ensuring that members’ information remains protected within the association. Members agree to respect the privacy of fellow members and to uphold confidentiality regarding any information shared within the Club.
5. Non-Commercial Agreement and Voluntary Contributions
Membership contributions, dues, and fees are made voluntarily to support the Club’s private activities. All contributions are made for the benefit of the Club’s mission and not for commercial profit or public gain. This agreement is purely a private, non-commercial contract between living men and women.
6. Dispute Resolution
Any disputes arising within the Club will be addressed privately through internal mediation in the spirit of peace and mutual respect. By signing this agreement, members agree to resolve conflicts within the Club’s private structure, outside of any corporate or statutory legal systems.
7. Termination of Membership
Membership may be terminated if a member violates the principles of common law or disrupts the peaceful, inclusive nature of the Club. Terminated members forfeit all dues and benefits, and termination decisions will be handled internally within the association.
8. Media and Photography Use
Members grant the UCSB Golf Club permission to use photos, videos, and media taken during Club events for private promotional, educational, or community-building purposes, within the Club’s private context.
Acknowledgment of Understanding and Agreement
By signing below, I acknowledge that I am a living man or woman, voluntarily joining the UCSB Golf Club, a Private Membership Association that operates independently of corporate, commercial, or statutory jurisdiction. I confirm that I have read, understood, and agreed to the terms of this PMA Agreement, Terms of Service, and Liability Waiver. I enter this agreement in peace and of my own free will.
